Terms of Service
Effective October 22, 2026
Please read Section 17 carefully. It says that you and we will resolve most disputes through individual, binding arbitration instead of in court, and that you and we both give up the right to a jury trial and to bring or join a class action. You can opt out of arbitration within 30 days, as Section 17 explains.
These Terms of Service (the “Terms”) are an agreement between you and Zeya AI Inc., a Delaware corporation (“Zeya”, “we”, “us”), which makes BoardFlight under the name Boardaux Studios. They cover boardflight.app and its subdomains, the BoardFlight command-line tool, Unity plugin and MCP server, the playground, the in-game feedback layer, and anything else we offer under the BoardFlight name (together, the “Service”).
By creating an account, signing in or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you don't agree, don't use the Service. If you use the Service on behalf of a company or other organization, you agree to these Terms for it and confirm that you have the authority to; “you” then means both you and it.
1. BoardFlight and Board
BoardFlight is a service for building, distributing, installing and testing games for Board, a tabletop game device. BoardFlight is independent and unofficial. It is not affiliated with, endorsed by, sponsored by or connected to board.fun or the makers of Board. “Board” refers to the device, and nothing more.
Games from BoardFlight are installed through your Board's own software, which Board's maker controls. A Board software update can change or break how BoardFlight works at any time, without notice to us. Board's maker has not reviewed BoardFlight or any game you get through it.
Your Board, your Board account, and Board's own software, SDKs, templates and tools are governed by your agreements with Board's maker, not by these Terms. You are responsible for following those agreements, including Board's developer terms if you make games.
The Service is offered only in the United States.
2. Who can use BoardFlight
- You must be at least 13 years old to create an account. If you are under 18, or under the age of majority where you live, a parent or legal guardian must agree to these Terms on your behalf and is responsible for your use of the Service.
- Children under 13 may not have an account. They may play games that a parent or guardian has installed on a Board from that adult's account, with that adult's permission and supervision. The account holder is responsible for that use.
- You may not use the Service if we have previously banned you from it, or if you are barred from receiving services under U.S. law, including because you appear on a U.S. government sanctions or restricted-party list.
3. Your account
- Give us accurate information, keep it up to date, and keep your password secret. An account is for one person. You are responsible for everything done with your account and its credentials, including API tokens, signed-in command-line tools and editor plugins, linked computers, and Boards you have signed in. If you think someone else has used your account, tell us at legal@boardaux.com right away.
- Your username is how everyone outside your teams sees you, including the developers of games you test. Don't choose one that impersonates someone, infringes someone's rights or is offensive. We may change or reclaim a username that breaks these Terms. Your real name, if you give one, and your email address are shown only to members of your teams, as the Privacy Policy explains.
- If you sign in with Google or Discord, your use of that sign-in is also subject to their terms.
- We send service emails, such as address verification, password resets, team invitations and library review decisions. You agree to receive notices from us electronically, by email or in the Service, and agree that they satisfy any legal requirement that a communication be in writing.
4. Teams
- Teams own games, package prefixes, channels, builds, testers, redeem codes, API tokens and playground projects. A team's owner and admins decide who belongs to it and what each member may do. Content you add to a team is controlled by that team, including after you leave it.
- If you create a team for an organization, you confirm that you are authorized to act for it.
- Claim only package prefixes you have the right to use. We may release or reassign a prefix that impersonates someone else or uses a name or trademark that isn't yours.
- Disagreements between members of a team are for them to resolve. We may help, but we don't have to.
5. The Service, and changes to it
We are always working on BoardFlight. We may add, change, limit, suspend or remove any part of the Service at any time, with or without notice. We may also set or change limits on its use, such as request rates, upload sizes, storage, and the length and number of playground sessions. Features we describe as experimental or preview may be less reliable than the rest.
We don't promise that the Service will always be available. If we decide to shut the Service down entirely, we will try to give you at least 30 days' notice by email.
6. Your content
6.1 You keep what you make
“Your Content” means everything you upload, submit or create through the Service: builds (such as APKs and web app bundles), library listings, images, video and other media, assets, playground projects and source code, release notes, signing keys, feedback and messages. You keep all the rights you have in Your Content. We don't claim ownership of it.
6.2 The permission you give us
You grant Zeya a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display and distribute Your Content, and to make the technical changes described in Section 6.4, only as needed to operate, secure and improve the Service and to do what you direct. For example, that includes delivering a build to the testers, codes and channels you choose, or to the public library when you publish there.
For a game you publish to the public library, the license also lets us show the game's name, its team's name, and its listing text, icon, artwork, screenshots and video, inside and outside the Service, to promote that game and BoardFlight. For example, we might show them on boardflight.app or on social media.
This license ends when Your Content is deleted from the Service, with three exceptions: copies in backups until those expire; anything we must keep for legal reasons; and builds already installed on someone's Board.
6.3 Your promises
You promise that:
- you own Your Content or have every right needed to use it and to grant the licenses in these Terms, and neither it nor its distribution infringes or violates anyone's rights or any law;
- your games do what their listings say, and contain no malware or concealed functionality;
- you comply with every law that applies to your games and to any data they collect, including privacy laws and the Children's Online Privacy Protection Act (COPPA); and
- your library listings are accurate, including the minimum age you give.
6.4 Builds, the feedback layer and signing keys
- BoardFlight checks that each build's package id is one your team is authorized to publish. It doesn't otherwise review, test or vouch for what a build contains, except when you run verification on a Board.
- If you turn on BoardFlight's in-game feedback or analytics for a channel, you authorize us to add our code to the builds published on that channel and, for Android builds, to re-sign them. We keep your original build. For a web game, some of this is on by default, and you can switch it off: a small update notice on its playground channel and on the channel that publishes it to the library, and play analytics on that library channel. Publishing a web build to one of those channels authorizes us to add our code to it in the same way.
- If you let BoardFlight generate a signing key for a game, we create it, keep it and use it only to sign that game's builds. We don't currently offer a way to export a key we generated. If you later sign the game with a different key, players may need to uninstall it before they can update. If you upload your own key, we store it encrypted and use it only to sign that game's builds.
- If you turn on game events for a channel, your game decides what it reports. You must not send personal information in an event (no names, nicknames, contact details or anything a player typed), and you are responsible for what your game sends.
- You must not turn on in-game feedback, analytics, game events, achievements or leaderboards in a game that is directed to children under 13.
6.5 Keep your own copies
BoardFlight is not a backup service. Builds are deleted automatically under the retention rules described in the Privacy Policy and shown in the dashboard. Keep your own copies of your builds, source code and signing keys.
6.6 Removing content
We may remove or disable any of Your Content, refuse to distribute it, or stop distributing a game at any time if we believe it breaks these Terms or the law, or could harm players, devices, other users or the Service. We don't have to monitor content, and we are not responsible for content we don't remove.
7. Distributing games and the public library
- You choose who receives your builds, through email grants, redeem codes and channels. You are responsible for what you distribute and for any terms you agree with your testers.
- The first time a game is published to the public library, we review it before it appears. We may approve it, ask for changes, or refuse it. Later, we may remove any game from the library for any reason, including quality, compatibility or content. Approval is not an endorsement. It does not mean we have checked that a game is safe, lawful or works.
- Unless you give players license terms of your own that they agree to, you grant each person who receives your game through the Service a non-exclusive, royalty-free license to install and use it on Board devices for personal, non-commercial purposes. Any terms of your own govern the relationship between you and your players. They may not conflict with these Terms, and they do not make us a party.
- You are responsible for your games and for supporting the people who play them. The library shows your team's name on your game's page.
- BoardFlight doesn't process payments. Nothing in the Service makes us a party to any transaction between you and anyone else.
8. Playing and testing games
- Each game on BoardFlight is made by the developer named on its library page. Most are independent developers. Some games are made by us as Boardaux Studios. The developer is responsible for the game.
- Pre-release builds may be unfinished. They can crash, lose progress or behave unexpectedly. You decide what is installed. A game goes onto your Board when you install it yourself through your Board's own page, or when you ask the BoardFlight app on your computer to. The app also installs newer versions of games already on a Board, unless you turn off automatic updates for it. Installing an update can close a game that is being played.
- The BoardFlight app runs on your computer. If you choose “Keep BoardFlight running”, it starts when you sign in to your computer and keeps working in the background, so that installs you ask for elsewhere and automatic updates can happen, and it updates itself there too. You can turn this off in the app, and you can unpair a Board at any time.
- Your redeem codes and access to a playtest are personal to you. Don't sell, publish or share them unless the developer allows it, and don't copy, extract or redistribute builds you receive.
- Feedback you send from inside a game, or from your phone after scanning a game's code, goes to that game's developer. Don't include personal information you wouldn't want them to have, such as your full name, address or phone number. A screenshot attached to feedback shows what is on your Board's screen.
- If a developer removes a game or your access to it, the game may stop being available to download or disappear from your games. We can't promise that any game will stay available.
9. The playground, AI tools and other services
- The playground is a cloud workspace for making web games. It runs in sandboxes that a third-party provider operates for us. Sessions are limited in length. Work that hasn't been saved may be lost when a sandbox stops.
- AI tools. The playground can use AI coding tools, such as OpenAI's Codex through your ChatGPT account, Anthropic's Claude Code through your Claude account, an AI provider your team connects with its own key, or an AI agent running on your own computer. You connect them with your own accounts, or your team does with its own. Your use of them is governed by their providers' terms and policies, which you must follow, and any charges are between you, or your team, and the provider. We don't supply, control or pay for these models.
- The assistant on the creators' dashboard answers questions about making games for Board and about BoardFlight, from our guides, Board's documentation and what your account can already see. It runs on an AI model we provide. It only reads: it never changes your games, builds, access or settings. Its answers can be wrong or out of date, so check them before you rely on them, especially before you publish a build or change who can play a game. We may limit how much it can be used, change it or stop offering it at any time.
- AI output (code, text, images and anything else an AI tool produces) may be wrong, insecure or unsuitable, or may resemble someone else's work. Before you rely on, publish or distribute output, you are responsible for reviewing and testing it and for making sure you have the right to use it. Output you generate through the Service is Your Content.
- Third-party tools and keys. The playground can connect to other services, such as asset generators and documentation servers, under those services' own terms. If a team admin adds an API key for one of them, every developer in the team's playgrounds can use it and can read it from inside the sandbox. The same is true of an AI provider key a team admin adds, except an OpenRouter key: we keep that one and give each playground session its own key with a spending limit, which we delete when the session ends. The provider bills the key's owner for that use. Add only keys you are authorized to share.
- Software on your computer. Our command-line tool and verification runner, and any AI agent you link to a playground, run on your computer with your permissions. You are responsible for what you allow them to do.
- We don't control third-party services, including Board's, Google's, Discord's, OpenAI's, Anthropic's, our sandbox and AI model providers', or the tools you connect to the playground. We are not responsible for them or for third-party websites we link to.
10. Acceptable use
You agree not to do, or help anyone else do, any of the following:
- break the law, or violate anyone's rights, including intellectual property, privacy and publicity rights;
- upload or distribute malware, spyware, or anything designed to damage, disrupt, take over or secretly monitor a Board or another device or network, or to collect personal information from players without proper notice and consent;
- upload content that is sexually explicit, sexualizes minors, promotes violence or terrorism, or harasses or demeans people based on who they are;
- impersonate any person, team or company, including Board's maker, or use package prefixes, game names or listings to mislead people about who made a game;
- mislead players about what a game is or does, including its suitability for children;
- access, or try to access, accounts, teams, builds or data you aren't authorized to reach, or probe, scan or test the Service's vulnerabilities (if you find a security problem, please report it to legal@boardaux.com instead);
- get around rate limits, quotas, session limits, access controls or package-id checks, including by using several accounts;
- use playground sandboxes for anything other than making games, for example cryptocurrency mining, relaying traffic, sending spam, attacking other systems or running unrelated workloads;
- overload or disrupt the Service, or scrape or crawl it other than through our documented API and within its limits;
- reverse engineer, decompile or disassemble our software, except where the law allows it despite this restriction;
- copy, extract or reuse Playground Materials (Section 11) outside the Service, including by asking an AI tool to reproduce them;
- send spam or unwanted messages, including through invitations or feedback;
- sell or resell access to the Service; or
- use the Service in a way that breaks your agreements with Board's maker, Google, Discord, OpenAI, Anthropic or any other provider.
11. Our software and intellectual property
The Service belongs to Zeya and our licensors. That includes the BoardFlight app for your computer, command-line tool, plugins and in-game feedback layer, and the BoardFlight and Boardaux names and logos. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to use the Service, and to install and use our client software, only in order to use the Service. Open-source components we include are governed by their own licenses.
The feedback-layer code we add to a build is licensed to you and your players only as part of that build.
The playground comes with instructions, skills, reference material and tool definitions that we wrote for the AI tools it runs (“Playground Materials”). They are our confidential information and part of the Service, including when they sit beside your project's files in a sandbox, or on your computer when you link an AI agent to a playground. You may use them only to make games through the Service. You may not copy, extract, publish or share them outside the Service, reuse them in another product, use them to build or train another product or AI model, or ask an AI tool to reproduce them for any of those purposes. Output that reproduces Playground Materials is Playground Materials, not Your Content. This paragraph keeps applying after you stop using the Service.
If you send us ideas or suggestions about BoardFlight, we may use them freely, without any obligation to you.
12. Copyright complaints
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). To file a notice, send our designated agent the following:
- your physical or electronic signature;
- the copyrighted work you say is infringed;
- the material you say infringes it, with enough detail for us to find it, such as a game's name, its package id or a URL;
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act for them.
Designated agent: Copyright Agent, Zeya AI Inc., legal@boardaux.com. Our agent's postal address and telephone number are listed in the U.S. Copyright Office's DMCA Designated Agent Directory.
If material you posted was removed and you believe that was a mistake or a misidentification, you may send our agent a counter-notice containing:
- your physical or electronic signature;
- the material that was removed and where it appeared before removal;
- a statement, made under penalty of perjury, that you have a good-faith belief it was removed as a result of mistake or misidentification;
- your name, address and telephone number; and
- a statement that you consent to the jurisdiction of the federal district court for your address, and that you will accept service of process from the person who sent the original notice or from their agent.
In appropriate circumstances, we close the accounts of people who repeatedly infringe. Under the DMCA, anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages.
13. Ending your use
- You may stop using the Service at any time. To delete your account, email legal@boardaux.com from the address on your account. The Privacy Policy explains what we delete and what stays, such as content that belongs to a team.
- We may suspend or close your account or a team, limit access to any part of the Service, or remove content if we reasonably believe you have broken these Terms, put us or others at risk or exposed us to legal liability, or if the law requires it or we discontinue the Service. When appropriate, we will tell you why, unless the law prevents it or telling you would compromise safety, security or an investigation.
- When your account ends, so does your right to use the Service, and we may delete Your Content. Games already installed on a Board may stay installed, but you will no longer be able to get new versions of them through BoardFlight.
- These continue to apply after your account ends: Section 6.2 for the exceptions in its last paragraph; Sections 6.3 and 6.6; the player license in Section 7 for games already distributed; Sections 11 and 14 through 20; and any other terms that by their nature should.
14. Disclaimers
THE SERVICE, AND ALL GAMES, BUILDS, AI OUTPUT AND OTHER CONTENT AVAILABLE THROUGH IT, ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, ZEYA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY. THOSE INCLUDE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE; THAT IT WILL WORK WITH ANY BOARD OR ANY VERSION OF BOARD'S SOFTWARE; THAT ANY CONTENT WILL BE PRESERVED; OR THAT ANY GAME, BUILD OR AI OUTPUT IS SAFE, ACCURATE OR SUITABLE FOR ANY PURPOSE.
YOU USE THE SERVICE, AND INSTALL SOFTWARE ON YOUR BOARD AND YOUR COMPUTER, AT YOUR OWN RISK. YOU ARE RESPONSIBLE FOR ANY DAMAGE TO YOUR BOARD OR OTHER DEVICES, AND FOR ANY LOSS OF DATA, THAT RESULTS. WE MAKE NO STATEMENT ABOUT HOW USING UNOFFICIAL SOFTWARE MAY AFFECT YOUR BOARD'S WARRANTY OR SUPPORT FROM BOARD'S MAKER.
Some jurisdictions don't allow certain warranties to be disclaimed, so some of these disclaimers may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER ZEYA NOR ITS AFFILIATES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS, WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. THEY ALSO WILL NOT BE LIABLE FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ANY DAMAGE TO DEVICES, OR THE COST OF SUBSTITUTE SERVICES. THIS APPLIES TO CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
These limits apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law. Some jurisdictions don't allow incidental or consequential damages to be excluded or limited, so some of these limits may not apply to you.
16. Indemnity
You will defend, indemnify and hold harmless Zeya and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, that arise from: Your Content, including your games and their distribution; your breach of these Terms or of the law; or your violation of anyone else's rights. We will tell you about any such claim, and we may choose to control its defense. You may not settle a claim that affects us without our consent. This section does not apply to the extent a claim arises from our own breach of these Terms.
17. Disputes and arbitration
17.1 Talk to us first
Before either of us starts an arbitration or court case, we each agree to try to resolve the dispute informally for at least 60 days. To start, send a written notice describing the dispute and what you want, with your name and your account's username and email address, to legal@boardaux.com. We will send any notice to the email address on your account. The time limit for bringing a claim is paused while we try to resolve it this way.
17.2 Arbitration instead of court
You and Zeya agree that any dispute, claim or controversy arising out of or relating to these Terms, the Service, or the relationship between you and us (a “Dispute”) will be resolved by final and binding arbitration on an individual basis, not in court. This includes Disputes about the interpretation, scope and enforceability of this Section 17, except as Section 17.5 provides. This Section 17 is the “Arbitration Agreement”.
17.3 Exceptions
Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also go to court to stop actual or threatened infringement or misuse of intellectual property, such as copyrights, trademarks and trade secrets, or unauthorized access to the Service.
17.4 How arbitration works
The American Arbitration Association (AAA) will administer the arbitration under its Consumer Arbitration Rules, which are available at adr.org. A single arbitrator will decide the Dispute. Any hearing will take place in the county where you live, or by phone or video if we both agree. If your claim is for US $10,000 or less, the arbitrator may decide it based on written submissions alone. The AAA's rules govern the payment of filing, administration and arbitrator fees, and they limit what a consumer pays. The arbitrator may award any individual relief a court could award, but only in favor of the individual party seeking it and only as far as needed to resolve that party's claim. The decision is final, and any court with jurisdiction may enter judgment on it. The Federal Arbitration Act governs this Arbitration Agreement.
17.5 No class actions and no jury
YOU AND ZEYA MAY EACH BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND ZEYA EACH GIVE UP ANY RIGHT TO A JURY TRIAL.
Unless you and we both agree, an arbitrator may not consolidate more than one person's claims. A court, not an arbitrator, decides any question about whether this Section 17.5 is valid or enforceable. If a court finds it unenforceable for a particular claim or form of relief, such as public injunctive relief, that claim or relief will be decided in court after the individual claims have been arbitrated, and everything else stays in arbitration.
17.6 Mass filings
If 25 or more similar demands for arbitration are filed against us by or with the help of the same or coordinated counsel, the AAA's Mass Arbitration Supplementary Rules will apply, and the demands may be administered and decided in batches as those rules allow.
17.7 Opting out
You may opt out of this Arbitration Agreement by emailing legal@boardaux.com with the subject “Arbitration Opt-Out”. Include your name, your account's email address and username, and a statement that you are opting out. You must send it within 30 days after you first agree to these Terms. If you already had an account before October 22, 2026, send it within 30 days after that date. Opting out does not affect any other part of these Terms.
17.8 If arbitration doesn't apply
If you opt out, or if this Arbitration Agreement is found unenforceable for a Dispute, that Dispute will be resolved only in the state or federal courts located in the State of Delaware, and you and we consent to the personal jurisdiction of those courts.
18. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. The Federal Arbitration Act governs Section 17. Nothing in these Terms takes away consumer protections that the law of the state where you live gives you and that cannot be waived by contract.
19. Changes to these Terms
We may update these Terms. When we do, we will post the new version here with a new effective date. If a change is material, we will tell you by email or in the Service at least 30 days before it takes effect. Changes needed for legal reasons, or for new features, may take effect sooner. If you keep using the Service after a change takes effect, you accept the updated Terms. If you don't accept them, stop using the Service and ask us to delete your account.
A change to Section 17 will not apply to a Dispute that one of us had already given notice of before the change took effect.
20. General terms
- These Terms, the Privacy Policy, and any feature-specific terms we show you when you use a feature are the entire agreement between you and us about the Service. They replace any earlier agreements about it.
- You may not assign or transfer these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization or sale of assets, or by operation of law.
- If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. Headings are for convenience, and “including” means “including without limitation”.
- We are not liable for any delay or failure caused by events beyond our reasonable control.
- You will comply with U.S. export control and sanctions laws when you use the Service.
- You and we are independent parties. These Terms create no agency, partnership or employment relationship, and give no rights to anyone else.
- California users: under California Civil Code §1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
